General Terms and Conditions- Home Broadband Services

This document details the terms and conditions for the provision of the Services by Hutchison Telephone Company Limited. The Subscriber is deemed to have accepted the Conditions and the relevant tariffs when applying for the Services.

"Agreement" means the Conditions herein and the Special Terms and Conditions as may be amended by Hutchison Telephone Company Limited from time to time;
"Cancellation Charge" means the cancellation charge as stipulated from time to time payable as liquidated damages to Hutchison Telephone Company Limited on termination of the Agreement prior to expiration of any Minimum Commitment Period;
"Charges" means any applicable charges charged by Hutchison Telephone Company Limited for the provision of Services, Software or Equipment from time to time including, without limitation to, storage charges and other connection time charges, access charges, handling charges, access kit charges, installation, removal or delivery charges, late charges and such other fees and charges payable by the Subscriber to third parties through using the Services (including PNETS charges) as may be charged from time to time;
"Conditions" means the terms and conditions set out herein;
"Contents" refers to any software, content, data, information or other material that is accessible by / through using Hutchison Telephone Company Limited's Services including, but without limitation to, all electronic mail and other messages and all textual, audio, video, still image, graphical and other content;
"Content Provider" means any party providing Content and/or operating services accessible by/ through using the Services;
"Due Date" means the due date specified in the relevant invoice, or if no such date is specified, the date which is 14 days from the date of the invoice;
"Equipment" means the equipment (if any) provided by Hutchison Telephone Company Limited to make available Services to Subscriber which may be installed at the Premises for the use of the Services;
"Hong Kong" means the Hong Kong Special Administrative Region of the People's Republic of China;
"Minimum Commitment Period" means the minimum period as may be stipulated from time to time that the Subscriber commits to use the Services;
"Password" means any password or similar device issued or provided by Hutchison Telephone Company Limited to the Subscriber or chosen by the Subscriber (as may be from time to time varied by the Subscriber in the manner stipulated by Hutchison Telephone Company Limited or otherwise varied by Hutchison Telephone Company Limited), where applicable, which allow access to or hold up or delay any or all of the Services (where appropriate);
"Personal Data" shall have the meaning ascribed to it by the Personal Data (Privacy) Ordinance, Cap 486 of the laws of Hong Kong;
"PIN" means any login ID and/or other personal identifier(s) issued by Hutchison Telephone Company Limited to the Subscriber to gain access to all or any of Hutchison Telephone Company Limited's Services;
"Premises" means any premises or place at which the Services are used from time to time;
"Services" means telecommunications services, including Equipment where applicable as shall be provided by Hutchison Telephone Company Limited from time to time;
"Software" means any software supplied by Hutchison Telephone Company Limited to the Subscriber for the use or access to the Services;
"Special Terms and Conditions" means specific terms and conditions (if any) as applicable to the relevant Services from time to time;
"Subscriber" means any person including any individual, corporation or unincorporated body who apply for or use any of the Services of Hutchison Telephone Company Limited or to whom Hutchison Telephone Company Limited has agreed to provide Services.

In this Agreement, reference to one gender shall include the other and the neuter and reference to singular shall include the plural and vice versa.

  1. All applications for the Services shall be subject to review and acceptance by Hutchison Telephone Company Limited.
  2. Hutchison Telephone Company Limited will issue invoice to the Subscriber in accordance with Hutchison Telephone Company Limited's normal billing cycle for the type of Services provided, by post or email or any other method as Hutchison Telephone Company Limited thinks appropriate. If the Subscriber opts for changing other method for receiving its invoice, the Subscriber shall notify Hutchison Telephone Company Limited by giving 30 days prior written notice accordingly and Hutchison Telephone Company Limited reserves the right to charge a handling fee for each invoice to be sent thereafter.
  3. Unless otherwise provided or agreed by Hutchison Telephone Company Limited, an administration fee of HK$100 or any amount as shall be determined by Hutchison Telephone Company Limited from time to time shall be charged to the Subscriber for each duplicate copy of statement, registration form, service installation form or any other similar documentation as may be kept by Hutchison Telephone Company Limited.
  4. Hutchison Telephone Company Limited reserves the rights to charge the Subscriber a handling fee of HK$10 or any amount as shall be determined by Hutchison Telephone Company Limited from time to time on each payment transaction.
  5. The Subscriber shall pay Hutchison Telephone Company Limited the Charges detailed in each invoice in full on or before the Due Date. Questions concerning any invoice must be brought to Hutchison Telephone Company Limited's attention within 15 days of invoice date, otherwise, the invoice shall deem to be accepted by the Subscriber.
  6. The Subscriber agrees and authorizes Hutchison Telephone Company Limited to debit the full amount payable under Hutchison Telephone Company Limited's invoice or any amount due and payable by the Subscriber to any of the Group Companies from the credit card account registered with Hutchison Telephone Company Limited, if any, and the Subscriber shall be responsible for renewing such authorization from time to time; or if the Subscriber opts for settling the invoice or any payment due by the Subscriber to Hutchison Telephone Company Limited by way of bank auto-payment, the Subscriber shall sign and submit an authorization form and do all that is necessary to authorize Hutchison Telephone Company Limited to debit his designated bank account. The Subscriber also agrees to abide by and agrees to the terms and conditions of any third party provider where any Services shall be provided by or through these third party providers. All payment made shall be non-refundable and non-transferable. All payment to be made shall be without any deduction or set-off. Hutchison Telephone Company Limited reserves the right to use any account balance to set-off against any or all payment due by the Subscriber to the Group Companies.
  7. In case of disputes over any usage of the Services or the Charges, Hutchison Telephone Company Limited's decision based on its usage records and those of any third party in providing the Services shall be final and binding on the Subscriber.
  8. Hutchison Telephone Company Limited may impose a credit limit for the account of the Subscriber as determined by Hutchison Telephone Company Limited from time to time at its sole discretion. Should any Charges exceed such credit limit, Hutchison Telephone Company Limited shall be entitled to suspend or terminate the provision of the Services in whole or in part to the Subscriber and/or to charge all outstanding Charges against the credit card account registered with Hutchison Telephone Company Limited, if applicable. Notwithstanding the suspension of the Services, the Subscriber is still liable to pay the Charges current from time to time for the Services suspension period until the end of the Minimum Commitment Period or any liquidated damages as stipulated in the Services (if applicable).
  9. If the Subscriber has not fully settled any invoice by the Due Date, Hutchison Telephone Company Limited reserves the right to charge interest on any outstanding amount at 2% per month until the invoice has been paid in full by the Subscriber and to charge a reconnection fee and handling fee if the Subscriber's access to Hutchison Telephone Company Limited is suspended or terminated as a result of payment not having been made. Subscriber acknowledges that Hutchison Telephone Company Limited may invoice the Subscriber on behalf of a third party service provider or Group Companies. Hutchison Telephone Company Limited shall be entitled to employ debt collection agency and/or institution to collect any or all sums due but unpaid by the Subscriber and in so doing, Hutchison Telephone Company Limited may and is hereby authorized to disclose to such agency and/or institution any or all information available in relation to the Subscriber and Hutchison Telephone Company Limited shall not be liable or responsible for any default, negligence, act, conduct, misconduct and/or deeds of such agency and/or institution. The Subscriber shall be obliged to indemnify Hutchison Telephone Company Limited for all losses, damages, expenses incurred by Hutchison Telephone Company Limited in employing such debt collection agency or institution.
  10. Except for Content which is produced by Hutchison Telephone Company Limited and third party service provider, it is not Hutchison Telephone Company Limited and third party service provider 's policy to exercise any editorial control over or edit or amend any Content before it is transmitted or made available through the Services. However, Hutchison Telephone Company Limited and third party service provider shall have the right to amend, block or delete any Content which is transmitted or otherwise made available by the Subscriber where any such Content is, in Hutchison Telephone Company Limited and third party service provider 's sole opinion defamatory, in breach of copyright, improper, annoying, likely to be offensive, illegal or otherwise not appropriate to be accessed by or through the Services.
  11. The copyright and all other intellectual properties and other rights in the Software are either owned by or licensed to Hutchison Telephone Company Limited and third party service provider. Hutchison Telephone Company Limited and third party service provider hereby grants to the Subscriber a non-exclusive and non-transferable license for the Subscriber to use the Software on the Premises in accordance with this Agreement and the Software license which accompanies the Software but not further or otherwise. Except to the extent permitted by law, the Subscriber shall not alter, modify, adapt or translate the Software nor decompile, disassemble or reverse engineer the same nor attempt to do any such thing.
  12. The Subscriber agrees to keep the PIN and/or Password confidential and be responsible for any and all use of the Services using the Subscriber's PIN and/or Password, if applicable. If the Subscriber believes that his PIN or Password has been lost or stolen, the Subscriber should immediately notify Hutchison Telephone Company Limited and the Subscriber shall be liable for all Charges and cost incurred until the Services is being suspended by Hutchison Telephone Company Limited.
  13. The Subscriber shall at all times fully comply with all legal and regulatory requirements applicable to the use of the Services and observe all instructions or guidelines as may be imposed by Hutchison Telephone Company Limited and third party service provider from time to time. The Subscriber further undertakes not to use or allow others to use the Services for any purpose which Hutchison Telephone Company Limited and third party service provider considers improper, immoral, defamatory, fraudulent or otherwise unlawful. In particular, the Subscriber shall not hack, break into, access or use or attempt to hack, break into, access or use any part of the Services, any content and/or any data on Hutchison Telephone Company Limited and third party service provider server(s) or telecommunications network, for which the Subscriber has not been authorized by Hutchison Telephone Company Limited and third party service provider.
  14. Hutchison Telephone Company Limited and third party service provider reserves the right at all times to suspend all or any of the Services without notice whether or not to carry out system maintenance, upgrading, testing and/or repairs or otherwise as it deems appropriate. No credit or refund is available when all or any of the Services is down or suspended in any manner whatsoever.
  15. Hutchison Telephone Company Limited and third party service provider shall have the right to send, deliver, distribute or display advertisements, messages or other information in such form and manner as it shall deem appropriate on the screen or to the media through which the Subscriber access the Services from time to time.
  16. The Subscriber may be required at its own costs to install Equipment, Software or reconfigure the Subscriber's computer equipment or other equipment or devices in order to obtain access to the Services. Unless otherwise provided, the Equipment is and will at all times remain the property of Hutchison Telephone Company Limited and the Subscriber will not acquire any rights or title in them.
  17. The Subscriber shall ensure that Hutchison Telephone Company Limited, its representatives and agents have safe access to the Premises at all reasonable times to install, inspect, maintain, repair, remove or recover the Equipment or to do anything that is reasonably necessary for the provision of Services under this Agreement. While the Equipment is in the Subscriber's custody or control, the Subscriber will be liable to Hutchison Telephone Company Limited for any loss or damages to the Equipment.
  18. Hutchison Telephone Company Limited may require the Subscriber to maintain a deposit with Hutchison Telephone Company Limited as security for the discharge of obligations and liabilities of payment by the Subscriber relating to the provision of the Services and/or the installation of Equipment or Software under this Agreement. The amount of the deposit shall be determined by Hutchison Telephone Company Limited at its sole discretion. Without prejudice to any other rights or remedies that Hutchison Telephone Company Limited may have against the Subscriber, Hutchison Telephone Company Limited reserves the right to apply and set-off the deposit against any outstanding Charges or for any loss or damages suffered or sustained by Hutchison Telephone Company Limited as a result of any non-performance or non-observance by the Subscriber of any provisions of this Agreement or under any of the Subscriber's other account under Hutchison Telephone Company Limited or the Group Companies. Upon termination of this Agreement, Hutchison Telephone Company Limited shall return any remaining balance of deposit without interest within 3 months from the date of termination.
  19. The Subscriber shall not use the Services to circulate, publish, transmit, distribute any unsolicited advertising or promotional information or any Content that is seditious, obscene, defamatory, indecent, threatening, offensive, liable to incite racial hatred, discriminatory, menacing or in breach of confidence or any applicable law and regulation; or which infringes the privacy of an individual; or may cause Hutchison Telephone Company Limited and third party service provider to breach any applicable law or regulation.
  20. Hutchison Telephone Company Limited and third party service provider exercises no control and shall not accept any liability whatsoever over the Content passing through the Services. Hutchison Telephone Company Limited and third party service provider makes no warranties of any kind including without limitation to fitness for purpose, quality standard or continuity, whether expressed or implied, for the Services it is providing and in particular disclaims any responsibility for the accuracy or quality of information obtained through its Services. Hutchison Telephone Company Limited and third party service provider will not be responsible for any damage in relation to the Services including loss of data, voice or other information resulting from delays, non-deliveries, mis-deliveries, or service interruptions.
  21. The Subscriber hereby agrees to indemnify and to keep Hutchison Telephone Company Limited and third party service provider fully and effectively indemnified against any action, liability, cost, claim, loss, damage, proceeding, expense suffered or incurred by Hutchison Telephone Company Limited and third party service provider arising from directly or indirectly related to the Subscriber's use and any other person's use of the Services where such person was able to access the Services by using the Subscriber's PIN and/or Password, including but not limited to claims for defamation, infringement of copyright or any other intellectual property rights; and/or any breach or non-observance of any provision hereunder by the Subscriber or any other person where such person was able to access the Services by using the Subscriber's PIN and/or Password.
  22. To the extent permitted by law, Hutchison Telephone Company Limited and any third party service provider of the Services shall under no circumstances be liable whether or not in contract, tort, statute or otherwise (including without limitation to negligence, breach of contract, defamation, or intellectual property right infringement) for any cost, claim, special, direct, indirect or consequential loss or damage (including without limitation, loss of revenue, loss of profit, or any consequential loss whatsoever) suffered, sustained or incurred by the Subscriber or any person (directly or indirectly) from or out of or relating to the Services.
  23. To the extent permitted by law, Hutchison Telephone Company Limited, its Group Companies and any third party service provider of the Services, together with their respective directors, employees or agents expressly disclaim any liability for: i) any damage to or loss of data, voice or other information arising from the Subscriber's use of the Services, Software or Equipment; ii) any claim based on contract, tort, or otherwise for any direct or indirect loss of revenue, profits or any consequential loss whether of an economic nature or any such loss which the Subscriber suffers as a result of any error, inaccuracy or computer virus in or introduced into the Subscriber's computer system or other devices by, through or in connection with the use of the Services, Software or Equipment; iii) any claim relating to the Services and/or any Content, Software or Equipment supplied, provided, sold or made available by or through the Services (or any failure or delay to so supply, provide, sell or make available); iv) any disruption or suspension or degradation of the Services or any part thereof; and v) any damage which is attributable to an event or circumstance beyond Hutchison Telephone Company Limited and third party service provider's control ("Force Majeure Event"). A Force Majeure Event includes but is not limited to acts of God, war, civil disobedience, explosion, fire, flood, governmental action, legislation not in force at the time of this Agreement, restraints imposed by government or any other regulatory authorities, labour disputes, trade disputes or delays of third parties over which Hutchison Telephone Company Limited and third party service provider has no control.
  24. Hutchison Telephone Company Limited may immediately terminate this Agreement and/or the provision of the Services without notice and without limiting any other remedies available to Hutchison Telephone Company Limited if any of the following events should occur: i) any outstanding Charges payable by the Subscriber remains unpaid 30 days after the Due Date; ii) the Subscriber becomes or is threatened to be the subject of bankruptcy, winding up or receivership proceedings; iii) the Subscriber permits outstanding Charges to exceed the credit limit established from time to time by Hutchison Telephone Company Limited; iv) the Subscriber is in breach of any terms of this Agreement; v) Hutchison Telephone Company Limited suspects fraud or misuse of the Services or any unauthorized activity in relation to the use of the Services by any person, regardless of whether the Subscriber consented to or had knowledge of such fraud, misuse of unauthorized activity; vi) Hutchison Telephone Company Limited is prohibited from providing the Services under any applicable law or regulation; or vii) any of the information provided by the Subscriber to Hutchison Telephone Company Limited in applying for the Services is found to be false, inaccurate or misleading.
  25. Without limiting the exclusions or limitations of liability herein, Hutchison Telephone Company Limited shall not be liable to the Subscriber nor to any third party for any loss or damages whatsoever resulting from or in connection with termination of this Agreement under clause 24.
  26. If the Agreement is terminated howsoever before the Minimum Commitment Period has expired, the Subscriber shall pay Hutchison Telephone Company Limited the Cancellation Charge upon termination.
  27. Unless otherwise provided, i) the Subscriber may terminate this Agreement by giving not less than 45 days prior written notice to Hutchison Telephone Company Limited; and ii) Hutchison Telephone Company Limited may terminate this Agreement by giving not less than 30 days prior written notice to the Subscriber.
  28. Upon the termination of this Agreement: i) all Charges for use of the Services up to and including the date of termination and all other amounts owing by the Subscriber to Hutchison Telephone Company Limited will become immediately due and payable; ii) the Subscriber shall cease to use the Equipment and Services; and iii) all licenses and other rights and privileges granted to the Subscriber including without limitation to any e-mail services shall be terminated immediately.
  29. Any termination shall not affect any accrued rights or liabilities of either party nor shall it affect the coming into force or the continuance in force of any provision hereof which is expressly or by implications intended to come into or continue in force on or after such termination.
  30. This Agreement constitutes the entire agreement and understanding between the parties and supersedes all prior arrangements or understandings, whether oral or written, between the parties relating to the subject matter hereof.
  31. All personal data supplied to Hutchison Telephone Company Limited for the provision of the Services shall be subject to its Privacy Policy Statement as may be amended from time to time, a copy of which shall be available upon request.
  32. The Subscriber shall notify Hutchison Telephone Company Limited in writing of any changes of his personal data for the purpose of enabling Hutchison Telephone Company Limited to provide or continue to provide the Services to the Subscriber.
  33. Hutchison Telephone Company Limited reserves the right to vary, delete, modify or add to the terms of this Agreement and the tariff, amount of deposit, credit limit and the Services from time to time and such variation and/or addition shall become effective when published or displayed or notified to the Subscriber in any manner as Hutchison Telephone Company Limited shall think appropriate, irrespective of whether the Subscriber has actual notice or knowledge thereof.
  34. The Subscriber shall not assign or otherwise deal with its rights and obligations under this Agreement, whether in whole or in part without the written consent of Hutchison Telephone Company Limited.
  35. Hutchison Telephone Company Limited may assign this Agreement or appoint any third party, including the Group Companies, to provide the Services to the Subscriber on its behalf or to perform any of Hutchison Telephone Company Limited's obligations under this Agreement.
  36. If any provision of this Agreement is determined to be illegal, unenforceable or invalid in whole or in part for any reason, it shall be severed from this Agreement and shall not affect the enforceability of the remaining provisions of this Agreement.
  37. No failure or delay on the part of Hutchison Telephone Company Limited to exercise any right, power or remedy under this Agreement shall operate as a waiver thereof, nor shall any single or partial exercise by Hutchison Telephone Company Limited of any right, power or remedy. The right, power and remedy provided herein are cumulative and are not exclusive of any right, power or remedy provided by law.
  38. These Conditions shall be subject to the relevant Special Terms and Conditions and if there is any inconsistency between them, such Special Terms and Conditions shall prevail to the extent of such inconsistency.
  39. Any provisions of this Agreement which by its nature extend beyond termination shall survive such termination.
  40. In the course of providing the Services, Hutchison Telephone Company Limited may need to record verbal instructions received from the Subscriber and/or any verbal communication between the Subscriber and Hutchison Telephone Company Limited in relation to the Services.
  41. This Agreement shall be construed in accordance with the laws of Hong Kong.


Special Terms and Conditions of Home Broadband Internet Access Service ("Broadband Service") ("These Special Terms and Conditions") Application of the Broadband Service

  1. These Special Terms and Conditions shall be subject to the General Terms and Conditions of Hutchison Telephone Company Limited. Customer who is a residential customer and has registered for Broadband Service provided by Hutchison Telephone Company Limited ("Subscriber") is deemed to accept the terms and conditions herein, as well as the General Terms and Conditions of Hutchison Telephone Company Limited that are in effect from time to time whenever he/she applies for the Broadband Service and chooses to continue subscribing to the Broadband Service.
  2. Unless otherwise provided, terms used herein shall bear the same meanings as described in the General Terms and Conditions of Hutchison Telephone Company Limited.
  3. Unless otherwise stated, Hutchison Telephone Company Limited reserves the right to terminate any plan under the Broadband Service ("Plan") at any time and/or vary the monthly fee and all such applicable terms thereunder from time to time.
  4. Subscriber understands that the Broadband Service shall only take effect after Hutchison Telephone Company Limited has approved his/her application. Hutchison Telephone Company Limited's decision on whether to accept Subscriber's application for the Service shall be final and conclusive.
  5. Subscriber who has successfully registered any Plan shall be entitled to enjoy the relevant offers provided thereunder for using the Broadband Service. Hutchison Telephone Company Limited and third party service provider endeavours to provide the Broadband Service within a reasonable time after completing registration of the Broadband Service. Under normal circumstances, Hutchison Telephone Company Limited and third party service provider shall require not more than 7 Business Days upon receipt of the relevant application from the Subscriber to process the registration of any Plan. Hutchison Telephone Company Limited and third party service provider endeavours to provide notification within 30 days or any other period as soon as reasonably practicable in advance of the Plan's effective date.
  6. Hutchison Telephone Company Limited reserves all its rights and final discretion to terminate the registration of any Plan of any Subscriber. All rights and benefits incidental to the registration under any Plan shall cease immediately upon the termination of such registration for any reason whatsoever.
  7. Subscriber understands that upon completing registration to a Plan, he/she shall not be entitled to any other offers and that the Plan cannot be used in conjunction with other plans or promotional offers as may be offered by Hutchison Telephone Company Limited from time to time.
  8. "Business Day" means any Mondays to Fridays in Hong Kong except for public holidays.

  9. Minimum Commitment Period of the Broadband Service Plan
  10. Upon expiry of the Minimum Commitment Period (as defined in the Hutchison Telephone Company Limited General Terms and Conditions) of the contract under any Plan, the monthly fee will be adjusted to the standard monthly fee as set out by Hutchison Telephone Company Limited.
  11. If Subscriber terminates the subscribed Broadband Service within the Minimum Commitment Period for whatever reason, Hutchison Telephone Company Limited reserves the right to charge the Subscriber a stipulated standard installation fee for the Service at its own discretion.
  12. If the Subscriber terminates the subscribed Broadband Service or the Plan(s) at the installation address within the Minimum Commitment Period for whatever reason, Subscriber shall pay as liquidated damages to Hutchison Telephone Company Limited the total amount of the special monthly fees payable for the remaining commitment period. If Subscriber terminates the Plan(s) as a result of moving to an area outside of Hutchison Telephone Company Limited's service coverage, the liquidated damages payable shall be calculated as the sum of the following amounts : (i) any previously waived installation charge or any difference between the standard installation fee and installation fee paid; and (ii) if applicable, pro-rata listed price of the premium which is calculated based on the remaining months of the Minimum Commitment Period (e.g. if the listed price of the premium is HK$2,400, Minimum Commitment Period is 24 months, and the Subscriber terminates the Service 6 months prior to the end of the Minimum Commitment Period, the pro-rata calculation will be as follows : HK$2,400 / 24 X 6 = HK$600). The listed price of premium shall be the amount as set out by Hutchison Telephone Company Limited. Subscriber agrees that Hutchison Telephone Company Limited can offset the liquidated damages with prepayment (or any part thereof) of related service and Subscriber shall pay the remaining balance of liquidated damages after this offset, if applicable. The above liquidated damages are a genuine pre-estimate of loss and not a penalty charge. All offers in the Plan(s) will also be terminated.

  13. Change of Plan
  14. The Plan cannot be changed during the Minimum Commitment Period. If Subscriber changes the Plan upon expiration of the Minimum Commitment Period, Hutchison Telephone Company Limited will charge a stipulated administration fee.

  15. Value Added Services
  16. Subscriber understands and agrees that the provision of value added services of Broadband Service is subject to availability and the discretion of Hutchison Telephone Company Limited. Value added services are provided to the Subscriber by Hutchison Telephone Company Limited and/or third party service providers. Subscriber's use of value added service is subject to the special terms and conditions of the relevant value added service and all the terms and conditions stated therein that may be in effect from time to time. Subscriber agrees to be bound by these respective terms and conditions.

  17. Monthly Statement issued by Hutchison Telephone Company Limited
  18. Hutchison Telephone Company Limited will send all monthly statements to the Subscriber's designated email account. If Subscriber provides no such email account to Hutchison Telephone Company Limited or Subscriber opts to receive monthly statement by post, Hutchison Telephone Company Limited will send the monthly statement to Subscriber by post to his/her correspondence address registered with Hutchison Telephone Company Limited and Hutchison Telephone Company Limited will charge a stipulated handling fee.
  19. Subscriber acknowledges and agrees that Hutchison Telephone Company Limited will from time to time send monthly statements and other correspondence in relation to the Broadband Service via the designated email account or the correspondence address as provided by the Subscriber, where all correspondence will be distributed as official notice.
  20. Subscriber acknowledges and agrees that Hutchison Telephone Company Limited may from time to time send or email to the Subscriber information and/or promotional materials of services provided by Hutchison Telephone Company Limited and/or any third party. Subscriber shall notify Hutchison Telephone Company Limited if he/she does not want to receive any such material or information and Hutchison Telephone Company Limited will not charge any fee for this request.

  21. Maintenance
  22. Hutchison Telephone Company Limited and third party service provider will charge a stipulated maintenance fee for all on-site maintenance service, unless any failure/problem is due to the failure of the system or equipment/accessories of Hutchison Telephone Company Limited and third party service provider.
  23. Should Subscriber require re-installation of the Broadband Service due to any change of installation address, Hutchison Telephone Company Limited will charge a stipulated installation fee for the service relocation.

  24. Compliance with Hutchison Telephone Company Limited's Guidelines
  25. Subscriber shall comply with guidelines given by Hutchison Telephone Company Limited and third party service provider from time to time in relation to modifications required to any apparatus at the Premises or such other actions that are necessary to eliminate any interference, impediment or impairment to the Service or the Network.

  26. Termination of Broadband Service
  27. If Subscriber terminates the Broadband Service, Subscriber is required to give at least 45 days' prior notice to Hutchison Telephone Company Limited (if applicable). All Equipment (if applicable) provided by Hutchison Telephone Company Limited must be returned to Hutchison Telephone Company Limited shops within 30 days after termination date of the Plan(s). If Subscriber does not return the Equipment within the said period or in case of any loss of or damage to the Equipment or any part thereof, Hutchison Telephone Company Limited will charge Subscriber a stipulated charge for the Equipment (for details, please refer to General Charge Items). Hutchison Telephone Company Limited will either debit such amount directly from the credit card account registered by the Subscriber with Hutchison Telephone Company Limited (if applicable) or handle it as debt payable by Subscriber without further notice and such amount will be recorded in Subscriber's Hutchison Telephone Company Limited account (if applicable).
  28. Termination will take effect on the next day after 45 days following the receipt of the 45-day termination notice given by the Subscriber. No written notification will be issued separately by Hutchison Telephone Company Limited after the Broadband Service has been terminated.
  29. Should Subscriber wish to re-install the Broadband Service after termination of the Plan, Hutchison Telephone Company Limited will charge a stipulated installation fee.

  30. Extent of Liability
  31. Subscriber understands and accepts that Hutchison Telephone Company Limited and third party service provider disclaims any liability for (i) any damage to or loss of data, software and/or hardware pre-installed in Subscriber's computer; (ii) any claim for any direct or indirect loss of revenue, profit or any consequential loss whether of economic nature or any such loss the Subscriber or any third party may suffer as a result of error, disruption and/or computer virus introduced into Subscriber's computer system; and (iii) any claim for the disruption or suspension of Subscriber's computer or any part thereof.
  32. Subscriber understands and accepts that the Broadband Service will fail, be interrupted, delayed or suspended in circumstances of power failure or for any other instances that are beyond Hutchison Telephone Company Limited and third party service provider's reasonable control. Hutchison Telephone Company Limited and third party service provider shall in any such case resume the provision of the Broadband Service as quickly as reasonably possible. Hutchison Telephone Company Limited and third party service provider shall not in any way be held liable for any loss and damage arising out of such failure, interruption, delay and suspension directly or indirectly. Hutchison Telephone Company Limited and third party service provider makes no warranty as to the quality and availability of the Broadband Service and accepts no liability in relation thereto.
  33. The Broadband Service shall be for residential use only. Should Hutchison Telephone Company Limited and third party service provider have reasonable grounds to believe that the Broadband Service is used for non-residential and/or private Subscriber's normal usage pattern or commercial use, Hutchison Telephone Company Limited and third party service provider reserves the right to terminate the Broadband Service forthwith.

  34. Prohibition of Use
  35. Broadband network login ID shall be assigned by Hutchison Telephone Company Limited and third party service provider and cannot be changed.
  36. Subscriber has to follow the guidelines and technical specification requirements given by Hutchison Telephone Company Limited and third party service provider from time to time in order to enjoy the Broadband Service, including but not limited to the computer hardware and software as recommended in the "Broadband Internet Service Guide" of Hutchison Telephone Company Limited and third party service provider.
  37. Subscriber shall not run any server type application in providing any type of service to others in any way through the Broadband Service. Such server type application includes, but is not limited to, email server, web server, ftp server, dhcp server, proxy, usenet news, multi-user interactive forums, irq and/or multi- user game host.
  38. Only one public IP address is assigned dynamically to each Subscriber by Hutchison Telephone Company Limited for his/her connection to the public Internet. Such public IP addresses will be changed from time to time and Subscriber is restricted from getting more than one public IP address by any other means.
  39. Subscriber shall not connect any fixed IP device to Hutchison Telephone Company Limited and third party service provider's Network.
  40. Subscriber shall not use any unofficial system (other than Hutchison Telephone Company Limited and third party service provider's authorized login system) to connect to Hutchison Telephone Company Limited and third party service provider's Network.
  41. The Broadband Service may be made available to Subscriber through the Optical Network Terminal, Ethernet or any other technology. Hutchison Telephone Company Limited may lease the relevant Equipment including without limitation the Optical Network Terminal and/or any other accessories (where applicable) to the Subscriber whilst he/she is subscribed to the Broadband Service.

  42. Provision of the Equipment
  43. Ancillary equipment for broadband network installation will be lent to the Subscriber for free with details printed on the service installation form. During the installation, an Hutchison Telephone Company Limited technical officer will explain to the Subscriber in detail.
  44. Hutchison Telephone Company Limited reserves the right to charge the Subscriber a stipulated Equipment rental fee. The Equipment shall at all times remain the property of Hutchison Telephone Company Limited.
  45. The rental of the Equipment shall be terminated immediately following the termination of the Broadband Service. Hutchison Telephone Company Limited reserves the right to terminate the rental of the Equipment to the Subscriber at any time and for whatever reason, whereby Hutchison Telephone Company Limited shall endeavour to provide a notification of 30 days or any other period as soon as reasonably practicable in advance of the effective date.

  46. Miscellaneous
  47. Specifications of 1000M/800M/500M/200M/100M are based on internet connection from the wallplate at Subscriber's premises to the first piece of Hutchison Telephone Company Limited and third party service provider's network equipment. Maximum upload/download speed to local site could be up to 1000Mbps/800M /500Mbps/200Mbps/100Mbps. The actual bandwidth that the Subscriber can enjoy may be affected by Subscriber's hardware / software, router specification, site traffic loading, type of content being accessed and other environmental factors; and hence is normally less than the above speed. The bandwidth to overseas sites will also be subject to the conditions of local network there, and therefore the bandwidth might be even less.
  48. System requirements for 1000M broadband service: Intel Core2 Duo P8700/2.53 GHz CPU or above, 4GB system memory or above, 64GB SATA II SSD (Read/Write >200MB/s) hardware system, Windows 7 or above, 100/1000M Ethernet card or other system requirement required from time to time. When using the broadband service, it is necessary to use the Optical Network Terminal provided by Hutchison Telephone Company Limited and third party service provider for successful connection with the network. The Optical Network Terminal needs to be plugged into the voltage transformer adapter to the external power. This voltage transformer / adapter is only suitable for the Optical Network Terminal offered by Hutchison Telephone Company Limited and third party service provider. Please do not use this voltage transformer / adapter with other electrical appliances for safety precaution. The optical fibre is extremely sharp as it consists of fine glass line. Should Subscriber finds the optical fibre line exposed to air, please contact Hutchison Telephone Company Limited immediately. Hutchison Telephone Company Limited will send technical specialist to follow up. If Subscriber finds the optical fibre exposed and cracked, please stay away from the optical fibre or its chip to avoid danger. When disposing of the cracked optical fibre and its chip, Subscriber should put them into a sealed container marked with warning message before further handling. Never throw away the optical fibre and its chips in the rubbish bin which does not carry any warning messages and protective measure. Do not smoke or leave tinder or overheated electrical appliance near the optical fibre. Upon successful installation of the optical fibre, please do not look at the exposed optical fibre or the connection point of optical fibre as its strong light will have negative effect on human eyes.
  49. Subscriber may select "Service Commencement Date" for the Plan provided that this date must be within 365 days after service installation date. Services included in the Plan(s) will become effective on the "Service Commencement Date". Subscriber must confirm the "Service Commencement Date" before service installation and the contract will commence on the "Service Commencement Date" once confirmed. Subscriber understands that service will not be available from service installation date to the "Service Commencement Date". If any services or the Plan being terminated after service installation date and before the "Service Commencement Date" for whatever reasons, Subscriber shall pay a total amount of remaining special monthly fee within Minimum Commitment Period to Hutchison Telephone Company Limited as liquidated damages, and all the offers will also be terminated at once.
  50. Terms and Conditions of Cooling-off Period: (1). Subscriber is entitled to a 14-day cooling-off period commencing from the date following the registration of designated service plan of residential Home Broadband. Subscriber may cancel the service plan(s) registered within the cooling-off period without any charges. Prepayment will also be refunded. However, the cooling-off period will immediately cease to apply if (i) Subscriber has collected any premium; or (ii) completion of installation. (2). If any service of a service plan is cancelled during cooling-off period, other service(s) included in the same plan and any other service plan(s) or value-added service(s) subscribed together on the same application will also be cancelled.
  51. Hutchison Telephone Company Limited reserves the right to final decision on any dispute regarding the Terms and Conditions herein stated.
  52. These Terms and Conditions shall be governed and construed in accordance with the laws of Hong Kong Special Administrative Region.
